The deprivation of liberty sentence represents one of the most forceful instruments of the state
power to deal with crime. However, throughout history, this approach has been permeated by
contradictions and inefficiency. The prison crisis, added to the increase in recidivism and crime,
reveals that the deprivation of liberty sentence fails to fulfill its fundamental objectives. In this
study, the general objective is to critically analyze the effectiveness of the deprivation of liberty
sentence in its resocializing function. As a methodology, documentary, exploratory and
bibliographic research was used. It was concluded that the deprivation of liberty sentence, in its
current format, is anachronistic, ineffective and incompatible with the objectives of a
Democratic State of Law.
